Blues Desert & Soul Terms of Service

Please read these Terms of Service (“Terms”) carefully. They constitute a binding agreement between you (“you” or “User”) and Blues Desert & Soul, Inc. (“Blues Desert & Soul,” “we,” or “us”).
By accessing, using, or logging into our websites and related services (collectively, the “Sites”), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use or access the Sites.
Additional services offered by Blues Desert & Soul may be governed by separate agreements, which will become part of your agreement with us if you use those services.
1. Accounts
- To use certain features or services, you may be required to create an account and password.
- You must be at least 18 years old and provide accurate, truthful information. Impersonating others is prohibited.
- Account information must be updated if it changes.
- Accounts assigned by an administrator (e.g., employer) may be subject to additional terms and may be accessed, suspended, or disabled by the administrator.
- You may not share your account with anyone. Keep your password confidential and do not use it on other websites. Notify your system administrator if your account is compromised.
2. Modifications and Termination
- We reserve the right to modify, suspend, or terminate any features of the Sites at any time, with or without notice.
- Fees may be introduced or changed for certain services at our discretion.
- You may stop using the Sites if you do not agree with changes.

- By posting Content, you grant Blues Desert & Soul and its affiliates a perpetual, irrevocable, non-exclusive license to reproduce, store, transmit, publish, display, adapt, or otherwise use the Content. This license continues even if you stop using the Sites.
- You agree to indemnify and hold harmless Blues Desert & Soul from any claims arising from Content you post.
- Communications, suggestions, or feedback sent to us are not confidential, and we may use them without obligation or compensation.
4. Content Posted by Others
We are not responsible for, nor do we endorse, Content posted by other users. We are not liable for any loss, damage, or injury resulting from third-party Content.
5. Use of the Sites
- You may not use the Sites in violation of applicable laws, to infringe the rights of others, or to interfere with Site functionality or security measures.
- Inappropriate use may result in Content removal, account suspension or termination, and/or legal action.
- Using the Sites does not grant ownership of intellectual property. You may not use Site content without permission or legal authorization.
- Electronic communications through the Sites constitute consent to receive notices electronically. Notices sent to the email you provide are deemed delivered.
6. Intellectual Property
- All intellectual property on the Sites is owned by Blues Desert & Soul or its licensors.

7. Social Networks
- Certain features may integrate with third-party social networks (e.g., Facebook, Instagram, YouTube, Twitter).
- Use of such features is governed both by these Terms and the terms of the respective social networks.
8. Warranties and Disclaimers
- Services are provided using commercially reasonable care, “as is”, without warranties of any kind.
- To the fullest extent permitted by law, we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
- To the fullest extent permitted by law, Blues Desert & Soul and its affiliates are not liable for indirect, incidental, consequential, or exemplary damages, including lost profits, data loss, or third-party rights violations.
10. Links and Third-Party Content
- The Sites may contain links to third-party websites or advertisements.
- We do not control or endorse these sites or products and are not responsible for any loss or damage arising from their use.
11. Changes to Terms
- We may revise these Terms at any time. Continued use of the Sites after changes constitutes acceptance of the updated Terms.
12. Governing Law and Jurisdiction
- These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules.
- You agree that exclusive jurisdiction for any claim or dispute shall be in the courts located in Maricopa County, Arizona, and you consent to their personal jurisdiction.
- If any provision is deemed unenforceable, the remaining provisions remain in effect.
